Dennis Moore, D.-Kan., announced that the subcommittee will hold a field hearing in West Palm Beach, Florida, titled "The Homeowners' Insurance Crisis: Solutions for Homeowners, Communities and Taxpayers," to review the crisis related to the availability and affordability of homeowners' insurance around the country.&lt;br /&gt;Rep. Ron Klein, who represents Florida's 22nd District and is a member of the subcommittee, will also be participating in the hearing. Klein has called for federal involvement to help ease the rising cost of property insurance due to natural catastrophes.&lt;br /&gt;Klein has introduced the Homeowners' Defense Act of 2009 (H.R. 2555), which would allow states that choose to participate in a national catastrophe insurance pool to spread the risk of natural disasters.&lt;br /&gt;"Whether it is a hurricane in Florida, an earthquake in California, a wildfire in Arizona or a tornado in Kansas, there is no reason why we can't spread the risk across states and natural disasters in order to bring down prices for homeowners," Klein said when introducing his bill last month. It has additional staff in Washington, D.C. and Chicago.&lt;br /&gt;The report examines a provision in the GM and Chrysler bankruptcies that allows the automakers to avoid liability for the vehicles built pre-bankruptcy. While both would be responsible for launching recalls and repairing defects in their current fleet, they would not be responsible for injuries and deaths caused by those defects, according to the report.&lt;br /&gt;The report says that between the third quarter of 2003 and the fourth quarter of 2008, Chrysler fielded 3,497 death and injury claims; GM fielded 15,284. These represent an annual average of 636 and 2,779 casualties (individual deaths and injuries) respectively. With more than 40 million vehicles in the U.S. fleet, the two companies accounted for 47 percent of all claims filed against auto manufacturers during that time period, the report says. Yet, according to the group, GM and Chrysler only represent 38 percent of the market share.&lt;br /&gt;"Combined, GM and Chrysler have a disproportionate share of the claims," said Kane, president and CEO of Safety Research &amp;amp; Strategies, "and there is every reason to conclude that the injury and death rates will continue. But the claims will disappear and that will impact the rate of GM and Chrysler recalls and public safety in the future."&lt;br /&gt;From 2004 to 2008, Chrysler issued 109 recalls, affecting 11.4 million vehicles; GM launched 129 recalls, affecting 19 million vehicles.&lt;br /&gt;According to Kane, the absence of death and injury claims will likely decrease the number of recalls and remedies GM and Chrysler will conduct after the bankruptcies.&lt;br /&gt;"Automakers and NHTSA use death and injury data to monitor and recall defective vehicles," Kane said. "If the claims aren't filed, we lose an important defect surveillance tool. And if the companies bear no liability for deaths and injuries caused by the uncorrected defects, what incentive do they have to recall?"&lt;br /&gt;The Safety Research &amp;amp; Strategies report, which includes a full state-by-state breakdown of claims, finds that Texas, California, Florida, Ohio and New York lead the nation in Chrysler and GM death and injury claims. The bill was introduced by Senators Evan Bayh, D-Ind. and Sen. Mel Martinez, R-Fla., and cosponsored by Senators Bill Nelson, D-Fla., and Mike Crapo, R-Idaho.&lt;br /&gt;"This bill would help consumers by making property/liability insurance more readily available and improving the efficiency of the surplus lines insurance market," said National Association of Professional Surplus Lines Offices' President John Wood.&lt;br /&gt;In May, Representatives Dennis Moore, D-Kan., and Scott Garrett, R-N.J., introduced the same legislation (HR 2571) in the House of Representatives.&lt;br /&gt;The House passed similar versions of the bill in the last two sessions of Congress and the Senate took up a similar bill in 2007 but it took no action prior to the end of the 110th Congress, requiring that the bill be reintroduced in the 111th Congress.&lt;br /&gt;According to NAPSLO, HR 2571 will be passed under suspension in the House in early July.&lt;br /&gt;"This bill would simplify the tax remittance and compliance responsibilities surplus lines brokers must discharge and bring efficiency and cost reduction of regulatory compliance in placements with multi-state exposures," said Richard Bouhan, executive director of NAPSLO. "Such reform would benefit not only the brokers and underwriters who provide surplus lines insurance but also consumers who ultimately pay the price for the inefficiencies."&lt;br /&gt;NAPSLO officials said they are hoping to see action take place soon on the surplus line reforms and believe there will be wide support for the legislation, noting that NAPSLO and other industry organizations have worked together in advocating enactment of this type of legislation.&lt;br /&gt;"With the introduction of the bill in both the House and Senate, and wide support from the industry, we believe that this bill will be approved and signed into law," said Maria Berthoud, partner, B&amp;amp;D Consulting, who lobbies for NAPSLO. But while most car collectors know there's a big difference between the vehicles they collect and the ones they drive every day, not everyone insures his or her collectible and everyday vehicles differently. Experts say that could leave collectors in a financial bind should they need to file a claim.&lt;br /&gt;So how can you be certain your collectible car is insured properly? Here's a closer look:Think Actual Market ValueLike any other commodity, collectible vehicles--which include antiques, classics, street rods, modifieds and exotics--change in value on a frequent basis and their insurance should reflect that. For instance, a 1967 Shelby Mustang, which just a few years ago could be bought for as low as $35,000, is fetching around $200,000 at large auctions today. Daily-use vehicles are insured on an ACV (actual cash value) basis, which means if you have a total loss, you'll be paid the original purchase price of your car less all depreciation to the date of loss. But collectible cars should be insured based on something known as an agreed value basis. For example, a company called Classic Auto Insurance specializes in collectible autos. In the case of a total loss, it pays the insured party the true current market value of his/her collectible vehicle, as opposed to the original purchase price, less depreciation. This better reflects the nature of collectible cars, which tend to increase in value, rather than decrease.Don't Pay For Unused MilesTraditional insurers typically require coverage equivalent to an owner's primary car, even though car collectors usually only drive their antiques about 1,000 miles a year. Collectible car policies should be much less expensive than a standard driving policy, as it's anticipated that a collectible car will be driven far less than a regular use auto. For instance, Classic Auto Insurance offers policies in three mileage cutoffs: 1,000, 3,000 or 5,000 miles per year. Let's look at two hypothetical examples regarding liability and underinsurance coverage.&lt;br /&gt;Liability Coverage&lt;br /&gt;If you pay a policy premium for $25,000/50,000 in auto liability insurance coverage[1], this is what could happen if you negligently cause injury to another person in an auto accident and the injured person sues you. With significant injuries and damages, a jury might award the injured person $75,000 (a hypothetical figure). Under these facts, your insurance company would pay the injured plaintiff only $25,000 on your behalf, the amount of coverage you bought[2]. As a result, you could be held liable for payment of the remaining $50,000 yourself! This is a harsh result, I am sure you would agree.&lt;br /&gt;What would happen if you had purchased a larger $100,000/$300,000 policy? Your insurance company would ordinarily pay the injured person the entire judgment amount of $75,000. Consequently, you would not be obligated to pay any part of the judgment yourself. To sum it up, the more insurance coverage you buy the less likely it is that you will ever be called upon to pay any part of a legal judgment against you.&lt;br /&gt;Underinsurance Coverage (UIM)&lt;br /&gt;Your purchase of high insurance limits can also help you or your family members when one or more of you are injured through the fault of another driver. This might occur if you and/or relatives who live with you sustain serious injuries in a motor vehicle accident, and the negligent driver who caused the accident has less insurance coverage than you do.&lt;br /&gt;How does this work? As an example, let's say the negligent driver has purchased a $25,000/$50,000 auto liability insurance policy, and you have a policy that provides $100,000/$300,000 in UM coverage. Your injuries are serious. Your medical bills and lost wages are substantial. In your lawsuit against the negligent driver, a jury awards you $100,000 in damages. The defendant driver's insurance will pay you only $25,000, the maximum amount of liability coverage the defendant bought which can be paid to one person with respect to one accident. However, you can look to your own UM coverage to see if there is underinsurance coverage (UIM) available to you. Given the above facts, your insurance company would pay you $75,000 in underinsurance coverage.&lt;br /&gt;How do you arrive at the $75,000 figure? It happens this way. Under Virginia law, if there is UM coverage available to you in an amount greater than the defendant's liability coverage, you will have underinsurance coverage. If not, there will be no underinsurance for you[3].
